1. If denial of permission to remove a child from this state would likely effect a modification of custody, removal may not be denied absent an evidentiary hearing. Permission to remove may be granted to the custodial parent without an evidentiary hearing if the party opposing removal fails to make a prima facie showing sufficient to support a ruling in its favor. 2. The custodial parent is presumptively entitled to permission to remove the child out of state, unless the party opposing the motion establishes that removal would endanger the child's physical or emotional health and is not in the best interests of the child, Minn. Stat. § 518.18(d) (1982), or that the purpose of the move is to interfere with visitation rights of the non-custodial parent. Minn. Stat. § 518.175, subd. 3 (1982).
